王女士問:我正下offer,裏面有一條款,要承接房客(tenant),但是possession與adjustment要在completion以後2個月。這種情況,房客的房租要給誰,怎麼給?

Completion就是買家將雙方議定的房價給了賣家,賣家將產權轉給買家,買家在completion後就成了新房主。因此,在completion以後,王女士就是新的房主,房租當然是給新房主。Possessionadjustment日期是買賣雙協議,方便賣家買房或找房搬家。


如果是空房,CompletionPossessionadjustment可以都是同一天。如果賣家在賣房時仍住在裏面,賣家對買家offer中要求的Possessionadjustment日期覺得不夠,就可以counter回去,要求合理的天數。這是雙方研議,於雙方同意後實施,並且放在offer中,成為合約的一部分。


現在只是王太太同意賣家多住兩個月,和房客與其所付的房租無關。因此,房租當然是在completion後全數付給新房主,也就是買家。同時,買家具備房東所有的權力與義務,並不因為賣家在屋內多住兩個月有絲毫損傷或變更。這是買家必須注意的,也就是王太太必須要審視租賃合約及其條款、賣家必須將押金轉給買家、等等房東要做的相關事項。
