買方違約

我賣房子,買家是伊朗人,訂金是五萬,已經解除條件,訂金已經放進買家經紀公司的信託帳戶,現在買家經紀通知我的經紀,因為伊朗時局,錢可能無法匯進來。如果違約,1. 我是否可沒收訂金?2.我是否仍要付經紀費?3.有人說我沒有要買方銀行核准貸款的文件,所以買方如果不買,不能算違約,不能沒收訂金。

 

答:條件已經解除,買家沒有保護傘了,雙方合約正式生效。如果買家不履行合約,就是買家違約,訂金必須由賣家沒收,補償損失。當然,賣家必須付經紀費,因為買賣雙方的經紀都已經做了他們的工作,他們是善意的第三者。賣家付了經紀費仍然有餘,有餘就好了。當然賣家可以和其經紀商談不要支付那麼多,未來賣房大業仍由其經紀擔當,或許賣方經紀會答應。但是買方經紀費必須如數支付,因為賣家和買家經紀沒有直接關係,難有條件使買家經紀願意減少經紀費。如果賣家堅持不支付,那只有打官司,賣家不會贏。


賣家根本不需要買方銀行核准貸款的文件。是否要解除條件,是買家自己的判斷,與賣家無關。既然解除,綁住雙方的合約正式生效,誰都不能任意脫離。

建議讀者找能提供免費房地產買賣保險的經紀,做房屋買賣。當有事故發生時,能有免費的律師服務,更能有不限時數與次數的法律諮詢,及某些補償。詳細情況當視保險合約內容,會有條件限制。當然我在「保險條件限制」外,必定提供我顧戶「免費房地產買賣保險」,保障客戶的權益,免除後顧之憂。畢竟,律師的諮詢費,一小時300元是很嚇人的,更何況要上法庭打官司。贏了,對方付律師費,萬一輸了?
