蔣女士問:我現在租一間房間,以前和房東簽下6個月的租期,現在租期已過一星期,房東在租約到期時沒和我再重簽約,現在她找我要重簽定期合約,有朋友說不可以,但房東說這是她的權力,到底是怎麼樣?

房東錯了。她並沒有這項權力。按照住宅租賃法案(Residential Tenancy Act)規定,定期租約是房東與房客雙方同意一個事先決定租約到期日期的協議。如果定期租約到期,有兩種可能發生:

  1. 如果房東與房客在到期日前都沒重新簽新約,且租客仍然住在裡面,就推定是房東與房客雙方同意續簽原合約,但改為一個月一個月租期的約。

  2. 如果租客在租約到期日不續租,租約失效。

這樣當然對租客較有利,所以房東希望房客能簽長的定期約,但是她不能違反法令。對於蔣女士而言,要不要再重簽長的定期約,要看她的需求,如果她希望住在哪裡,當然可以。如果另有計畫,或要有較當的自由度,不簽長的定期約當然較好。
